A Certified Signing Agent is a Licensed Notary Public who has taken additional training in the proper processing and completion of Finance Documents pertaining to the Real Estate Industry. And currently possess additional Certification  which allows the Notary Public to perform Signing Agent duties. Also known as: Certified Loan Signing Agent, Certified Notary Signing Agent, Certified Signing Agent, Certified Mobile Signing Agent.

 A Certified Signing Agent is a Commissioned (licensed) Notary Public specifically trained in the processing and procedures of loan documents directly associated with the mortgage industry.

Because a Certified Signing Agent is PROHIBITED from advising a client and or offering suggestions a Notary Public certified in this area must abide by very strict guidelines.

Due to the limitations that are placed on a Notary Public while acting in the capacity of a Certified Signing Agent, the mortgage and finance industry is requiring specific training and proof of certification.

A Notary Public commission (Notary License) issued by the California Secretary of State, is valid for  4 years and will expire at the end each term. 

In order to renew a notary commission (Notary License) a Notary Public must retest, pass and be fingerprinted for a thorough background check every four years.

Although a Notary Public is trained to notarize documents. The California Secretary of State does not allow any formal training for the process and application of loan documentation. California Secretary of State mandates strict rules and guidelines for Notary Education which may not include Certified Signing Agent training in the Notary Class.

Loan Documents and the Certified Signing Agent Role:

The average set of loan documents for a purchase of a home, or refinance of a home can be up to 100 pages of paper. Within that set of documents there will be on average 2-3 documents requiring notarization, however there are several documents that also need to be completed and processed by the Notary Public. For example; Right of Rescission, Processing and Collection of Funds at signing and the Patriot Act, which was enacted after 9/11.

In addition each lender may have a variety of task that must be implemented by the Certified Signing Agent (Notary)


Because these steps are not considered notarization, this type of specific training is not allowed in the notarization course.
